In an effort to help healthcare practitioners and entities, including pharmacists/pharmacies improve healthcare quality, care, and patient safety, (including assessing errors and mistakes made with regard to patient care) the federal Patient Safety and Quality Improvement Act (PSQIA) encourages reporting of patient safety and healthcare quality improvement information to patient safety organizations (PSO). This is done through a patient safety evaluation system (PSES) by providing confidentiality and "privilege" over that information, known as patient safety work product (PSWP). Any records assembled or developed by a provider for reporting to a PSO and  actually reported to a PSO for the conduct of patient safety activities which could result in improved safety, care, and outcomes, are protected as PSWP. That protects the information from being accessed by government entities or courts (civil such as malpractice or negiligence, criminal, and administrative, including licensing), from being accessed by attorneys to be used as evidence, and is not subject to subpoena or court order. The NEED here is for more pharmacists/pharmacies to understand the PSQIA and the PSWP Privilege, how to create it and maintain it, learn in what instances the Privilege can be lost or fail to apply, and how to prevent it from happening. 

Learn about this law and the related Privilege. Learn how to set up a legally compliant system, how to train pharmacists, technicians and others to operate the program, and how to work with health law attorneys to maintain the Privilege in all legal settings when the Privilege is challenged or the information is being sought.
